PadelSuite Terms and Conditions

These terms govern the use of PadelSuite, the web and mobile platform for running padel clubs and for their players. PadelSuite is a service of [MSLARCO's legal name], tax ID (RUC) [number], located at [address], Ecuador ("MSLARCO", "we").
By creating an account or using the platform you accept these terms. If you accept them on behalf of a club, you declare that you have the authority to bind it.
1. What PadelSuite is
PadelSuite lets a padel club manage its venues, courts, rates, bookings, customers, cash desk, tournaments, school and rankings on the web, and lets its players book, pay, keep the score of their matches and follow their level from the app or the club's website. The features available depend on each club's plan and active modules; those announced as "Soon" are not yet part of the service.
2. Accounts and access
- Each person uses their own account with a verified email. Accounts are personal and non-transferable.
- You are responsible for keeping your password safe and for what is done with your account. If you suspect unauthorized access, change it and let us know.
- A player has a single account to book and play at different clubs. A club's staff join it by invitation, with the profile the club assigns.
3. The club and its responsibilities
The club that signs up for PadelSuite ("the club", "the customer"):
- Is the data controller for the data of its customers, players and staff generated at the club. MSLARCO acts as the data processor and processes that data only to provide the service.
- Declares that it has a legal basis to upload that data and, for children and adolescents attending its school, the consent of their mother, father or legal guardian where the law requires it.
- Sets its rates and its booking, payment and cancellation rules, and informs its players about them.
- Decides whom to invite as staff, which profiles and permissions to assign and when to deactivate someone.
4. Payments between the player and the club
- When a player pays for a booking, a class or an entry, the payment is made to the club: at its desk, by bank transfer to its account, or online through the club's own payment gateway (for example, Paymentez), contracted by the club with its own credentials.
- MSLARCO charges no commission on those bookings and does not hold that money: it does not receive, retain or split payments between the player and the club. Refunds, payment disputes and cancellation policies are the responsibility of the club and its gateway.
- Once the sale of videos recorded by the club's cameras exists, it will also be charged through the club's gateway, and MSLARCO may charge the club a share according to its plan.
5. Video recordings
When a player records their match with their phone, or the club with its cameras, the video is stored linked to that match. Whoever records must have the consent of the people who appear in it. Original videos are kept for a limited time ([period] days) unless the plan or the player asks to keep them longer.
6. Acceptable use
It is not allowed to:
- Upload data about people without the right to do so, or false data about third parties.
- Use the platform or the videos to harass, discriminate against or endanger anyone, especially minors.
- Falsify match results to alter a ranking or a level.
- Try to access another club's data, breach security, reverse-engineer or overload the service.
- Resell or sublicense the service without written authorization.
We may suspend an account or a club that breaks these rules, giving notice beforehand whenever possible.
7. Plans, trial and club payments
The club pays MSLARCO the monthly or yearly fee of its plan and any add-ons, at the prices published in the pricing section, VAT included. The free trial lasts the published period and requires no card. If there is no active plan when the trial or a paid period ends, the club is paused until it subscribes: its data is not deleted.
8. Intellectual property
PadelSuite, its code, design and brand belong to MSLARCO. The club keeps ownership of the data and files it uploads, and the player of their profile and videos; both grant us permission to host and process them only to provide the service.
9. Availability and support
We work to keep the platform continuously available, but there may be interruptions for maintenance or for reasons beyond our control. We will announce scheduled maintenance that affects use in advance.
10. End of service and data
The club can stop using PadelSuite whenever it wants, from its dashboard. When it ends, it can request an export of its data for [period] days; after that we will delete or anonymize it, except what the law requires us to keep. A player can request the deletion of their account at any time.
11. Liability
The service is provided with professional diligence. To the extent permitted by law, MSLARCO is not liable for indirect damages, for the commercial relationship between the club and its players, or for decisions the club makes based on the information in the platform. Nothing in these terms limits the rights granted by consumer protection law.
12. Changes
We may update these terms. If the change is significant, we will announce it by email or within the platform at least [period] days in advance. Continuing to use PadelSuite after that date means accepting the new version.
13. Governing law and contact
These terms are governed by the laws of the Republic of Ecuador. Any dispute will be submitted to the competent courts of [city].
